Acceptable Use Policy

This Acceptable Use Policy (the “Agreement”) sets forth the terms and conditions of Your Use of hosting and related services (“Services”). In this Agreement “You” and “Your” refer to You, as the user of Our Services, or any agent, employee, servant or person authorized to act on Your behalf. “We”, “Us” and “Our” refer to the hosting provider, as well as its subsidiaries and sister companies. This Agreement explains Our obligations to You, and explains Your obligations to Us for various services offered. When You Use Your account or permit someone else to Use it to purchase or otherwise acquire access to additional service(s) or products or to cancel Your service(s) (even if We were not notified of such authorization), this Agreement covers such service or actions. Our Terms of Service agreement (“TOS”) is incorporated herein by reference and is applicable to all Services under this Accepted Use Policy.
1. User Obligations
You represent and warrant that: Your content does not and shall not contain any content, materials, data, work, trade or service mark, trade name, link, advertising or services that actually or potentially violate any applicable law or regulation or infringe or misappropriate any proprietary, intellectual property, contract or tort right of any person and that You own Your account content and all proprietary or intellectual property rights therein, or have express written authorization from the owner to copy, use and display the content on and within Your server account. You also represent and warrant that the server content being hosted shall not be used in connection with any illegal activity.
You expressly (i) grant to Us a license to cache the entirety of the content that is submitted, stored, distributed or disseminated by you via the Services and your website, including content supplied by third parties, hosted under this agreement; and (ii) agree that such caching is not an infringement on any of your intellectual property rights or any third party’s intellectual property rights.
2. Prohibited Content & Activities
You agree not to use Our services to host, store, distribute, or engage in any content or activities that are illegal, harmful, or offensive. This includes, but is not limited to:
- Nudity and Pornographic Content: Any content containing nudity, pornographic material, or sexually explicit content is strictly prohibited.
- Hate Speech and Discrimination: Content that promotes hate, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Illegal Activities: Content or activities that promote, encourage, or facilitate illegal activities, such as copyright infringement, hacking, fraud, or drug trafficking.
- Violent and Extremist Content: Content that depicts, glorifies, or encourages violence, cruelty, or extreme acts.
- Malicious and Harmful Content: Content that contains malware, viruses, spyware, or any other malicious code.
- Harassment and Cyberbullying: Content that targets, harasses, bullies, or defames individuals or organizations.
- Child Exploitation: Any content related to the exploitation or sexualization of minors is strictly prohibited and will be reported to the appropriate authorities.
- Intellectual Property Infringement: Hosting or distributing any content that infringes on the copyrights, trademarks, or other proprietary rights of any third party.
- Warez, Cracks, and Pirated Content: Distributing or hosting warez, cracks, pirated software, or any other content intended to circumvent intellectual property rights.
- Proxy Services and Traffic Relaying: Operating any kind of proxy server, traffic relaying program, or using the service as a VPN for traffic tunnelling.
- Malicious Activities: Engaging in actions that cause harm to Us or other customers, such as getting our IP addresses blacklisted or launching DDoS attacks.
- Unacceptable Content: Uploading or hosting IRC bots, file storage services, mirror/banner-ad services, topsites, streaming services, Escrow, High-Yield Interest Programs (HYIP), investment sites (e.g., FOREX, E-Gold Exchange), bitcoin miners, sale of controlled substances without a permit, AutoSurf sites, Bank Debentures, lottery sites, muds/RPGs, hate sites, hacking-focused sites, IP Scanners, Brute Force Programs, Mail Bombers, and Spam Scripts.
We reserve the right to determine, at Our sole discretion, whether content or activities violate this policy. If prohibited content or activities are detected, We may take appropriate action, including but not limited to account suspension, termination, or reporting to relevant authorities, without prior notice or refund.
3. Resource Usage
3.1. General Limitations
In your use of the Shared Hosting Services, you may not:
- Use more than 10% of our platform’s processing capacity. Our resource limits (enforced by CloudLinux LVE) are designed for typical website usage and are not intended for sustained, high-intensity processes. Consistent usage at or near your account’s maximum allocated limits may result in suspension or termination.
- Run stand-alone, unattended server-side processes or any daemons (e.g., IRCd).
- Run any type of web spider or indexer.
- Run any software that interfaces with an Internet Relay Chat (IRC) network.
- Run any bit torrent application, tracker, or client.
- Participate in any file-sharing/peer-to-peer activities.
- Run any gaming servers.
- Run cron jobs that cause a disproportionate load on the server. While cron jobs can be scheduled to run frequently, they must be optimized to be efficient. Any cron job that consistently uses excessive server resources (such as CPU, memory, or I/O) may be disabled by our team, and we reserve the right to suspend accounts that repeatedly run resource-intensive cron jobs.
- Give away web space under a domain.
- Operate a proxy website or service.
- Act as a remote file host for other websites.
- Operate self-hosted file sync or “cloud storage” services (e.g., OwnCloud, Pydio).
- Run any news or blog websites that generate content automatically using bots.
3.2. Disk Usage & Storage
Overall Disk Space and Inode Limits:
The following limits apply per individual account:
- Shared Hosting (non-premium plans): Limited to 50GB disk space and 500,000 inodes
- Standard Reseller Accounts: Limited to 50GB disk space and 500,000 inodes per end-user account
- Premium Reseller Accounts: Limited to 100GB disk space and 1,000,000 inodes per end-user account
- Premium/Managed Hosting (non-reseller): Limited to 300GB disk space and 3,000,000 inodes
For reseller accounts, these limits apply to each individual end-user account created under the reseller, not as an overall limit for the reseller account itself. The overall limit for any account, including resellers, is capped at 10% of the server’s total resources.
File Type and Usage Restrictions:
The following restrictions apply to all account types unless otherwise specified:
- Backup Facility: You must not use the Hosting Services as a backup or file-sharing facility. All files must be web-visible and part of an active website.
- Multimedia Files: A maximum of 5GB can be used for music, video, or other multimedia files (e.g., .aac, .avi, .mp3, .mp4, .mpeg, .jpg, .png, .gif).
- Archives: A maximum of 1GB can be used for archives and disk images.
- Databases: A maximum of 1GB can be used for databases and database dumps (e.g., .sql files).
- Executables: A maximum of 1GB can be used for executable files.
- File Removal: We reserve the right to remove certain file types (e.g., mp3, mp4, tar.gz, zip, .wpress, .jpa, .exe, wav) without warning to maintain server stability.
- MySQL Databases: Individual databases are limited to 1024MB in size at our discretion.
For Premium/Managed Hosting accounts, the multimedia, archives, databases, and executables limits may be adjusted at our discretion based on legitimate usage requirements.
3.3. Specific Terms for Resellers
As a reseller, you are bound by all terms in this agreement. In addition:
- You must not resell our services unless you have purchased a specific reseller product.
- You are responsible for the good housekeeping of the services offered to you, including monitoring and deleting accounts or files that violate our terms.
- We may terminate a reseller account without warning for repeated breaches of these terms.
- Reseller accounts are limited to the number of end-user accounts specified in your plan.
- We will impose limits if your usage is deemed excessive or consumes more than 10% of the server’s overall resources.
4. Backup Policy
4.1. Backup Exclusions
Any hosting account may be excluded from our weekly or daily backups if it meets any of the following criteria:
Shared Hosting Accounts (non-premium plans):
- Uses more than 100GB of disk space
- Contains more than 1,000,000 inodes
- Is currently suspended
- Takes longer than 2 hour to complete its backup process
Standard Reseller Accounts:
- Uses more than 100GB of disk space
- Contains more than 1,000,000 inodes
- Is currently suspended
- Takes longer than 2 hour to complete its backup process
Premium Reseller Accounts:
- Uses more than 100GB of disk space
- Contains more than 1,000,000 inodes
- Is currently suspended
- Takes longer than 2 hour to complete its backup process
Premium/Managed Hosting Accounts (non-reseller):
- Uses more than 300GB of disk space
- Contains more than 3,000,000 inodes
- Is currently suspended
- Takes longer than 2 hour to complete its backup process
Users whose accounts are excluded from backups are solely responsible for maintaining their own backups.
4.2. Backup Storage & Process
Our backup service is a courtesy. We cannot be held responsible for missing or corrupt backup data. It is always advisable to maintain your own off-site backups.
Storing your own backups (e.g., from Softaculous or backup plugins) on your hosting account is strictly prohibited. Backups must be stored ‘offsite’ with a cloud provider.
Files and extensions that are excluded from our backups can be amended at any time at our sole discretion.
Our standard backup schedule is typically 7 daily backups retained for 28 days, but this can vary.
When an account is terminated, we may hold a backup for a maximum of 48 hours.
Restoring an account after cancellation, closure, or non-payment will incur additional administrative charges, the costs of which may vary depending on the size and resource demand as part of restoration.
4.3. VPS Backup Policy
VPS (Virtual Private Server) accounts are not included in our automatic backup schedules. Any backups taken of VPS servers are done at our sole discretion for infrastructure redundancy purposes only and cannot and will not be guaranteed or made available for restoration as part of the service.
VPS backups are not inclusive of the VPS service. Any restoration requests for VPS servers may be chargeable depending on the complexity and resources required.
It is imperative that all VPS clients maintain their own off-site backup solution in all cases. You are solely responsible for implementing and managing your own backup strategy for VPS services.
5. Email & Anti-SPAM Policy
You must comply with the CAN-SPAM Act of 2003 and all applicable anti-spam legislation. Sending mass unsolicited email (SPAM) is prohibited.
5.1. Prohibited Email Activities
- Using our network to receive replies to SPAM.
- Forging email headers (“spoofing”).
- Using third-party proxies or mailing software for spamming.
- Configuring a mail server to relay third-party emails without authentication.
- Hosting web pages advertised via SPAM (“spamvertising”).
- Using APIs to bulk-generate mailboxes.
- Using weblogs, chat rooms, guestbooks, etc., to transmit unsolicited bulk messages.
5.2. Email Sending & Storage Limits
- Sending Limits: Email sending limits are defined in your service documentation and must be adhered to at all times.
- Mailboxes: A single domain may not host more than 100 mailboxes.
- Storage: Total email storage per individual account shall not exceed 20GB.
- Connections:
- POP3: Up to 10 concurrent connections per IP.
- IMAP: Up to 30 concurrent connections per IP.
5.3. SPAM Enforcement
If we determine you have deliberately or recklessly sent SPAM, we reserve the right to:
- Assess a significant financial charge to your account to cover administration costs.
- Share your details with anti-SPAM organisations.
- Immediately suspend or terminate your account.
6. VPS (Virtual Private Server) Policies
6.1. Fair Usage
- Traffic (Bandwidth): Your monthly traffic is limited based on your VPS plan. Overage is not permitted; your account will be suspended until the next month if you exceed your limit.
- Disk Space: Your disk space is limited based on your VPS plan. Note that system files may occupy a portion of your allocated storage.
- Backups: VPS servers are not included in our automatic backup schedules. You are solely responsible for implementing and maintaining your own off-site backup solution. See Section 4.3 for full details.
6.2. Management Tiers
- Unmanaged: No assistance with software or server management is included.
- Managed: Includes a specified amount of technical assistance per month. Ideal for those who can handle day-to-day operations but need occasional help.
- Fully Managed / Monitored: Includes extended technical assistance per month and proactive server monitoring.
The specific amount of assistance time included is defined in your service plan documentation.
7. Support Services
7.1. Fair Use of Support
Our support services are provided to assist with issues directly related to the hosting platform and its availability. While we strive to be as helpful as possible, our support does not extend to website development, code debugging, third-party application issues, or other tasks outside the scope of our direct service management.
We reserve the right to limit support interactions if they are deemed excessive or fall outside this fair use policy. Please refer to our support documentation for a detailed breakdown of what is included with your specific service plan.
8. General Terms
8.1. Accounts & Security
You are responsible for all activity on your account and for maintaining the confidentiality of your password. You bear the full risk of loss and damage to your content. Our services are not intended for data archiving, and you are responsible for maintaining your own independent backups.
In the event of account suspension or termination due to a breach of this policy, access to all account data may be immediately revoked. It is Your sole responsibility to maintain regular off-site backups and to have secured any necessary data before any violation occurs. We will not be liable for any data loss resulting from suspension or termination.
8.2. Network & Downtime
We will use our best efforts to maintain a full-time Internet presence for your account. However, we are not liable for any damages resulting from network downtime due to utility interruption, equipment failure, natural disaster, or human error. Our total liability shall not exceed the amount paid by you within a given month.
8.3. Third-Party Software
We may provide third-party software (e.g., cPanel, Softaculous) on an “as is” basis. We are not responsible for any faults or damages caused by this software. You are responsible for any licensing fees required.
8.4. Reservation of Rights
We reserve the right to refuse service to anyone and to suspend or terminate accounts for any activity we deem harmful to our customers, operations, or reputation. This includes, but is not limited to, non-payment, illegal activities, harassment, and violations of this policy.
8.5. Limitation of Liability
The services are provided on an “AS IS” basis. We expressly disclaim all warranties. We are not liable for any loss of data, interruption of business, or other damages arising from the use of our services.
8.6. Legal Age
You attest that you are of legal age (18 or over) to enter into this Agreement.
